Terms and conditions

1. Scope

These terms apply to all contracts between Cyzex, Berlin, Germany (“Cyzex”, “we”) and our customers about creating and hosting a website.

Our offer is aimed exclusively at businesses within the meaning of § 14 of the German Civil Code (BGB), not at consumers.

2. Our service

  • We create a website for your business from the content you provide: your services, photos, opening hours and contact details. It works on phones, tablets and computers.
  • You see a draft within 48 hours of us receiving your complete content.
  • One round of revisions before launch is included.
  • We publish your website once you approve it, and host it with SSL encryption.

Also included: an address on cyzex.net (for example salon-lena.cyzex.net), or connecting a domain you already own; German and English; and small changes after launch, such as opening hours, prices, texts, photos and holiday notices, usually done within 2 working days. For larger changes, such as a new section or a redesign, we tell you the price beforehand.

If you’d like a new domain, you register it in your own name at a registrar of your choice and pay its yearly fee there. We guide you step by step, free of charge, and connect it to your website. The domain stays yours.

3. Early access and the free trial

  • The first 20 businesses can try Cyzex for 90 days free of charge.
  • No credit card is needed, and the trial does not renew automatically.
  • For early-access customers the one-off setup fee (normally €199) is waived.
  • Before the trial ends, we ask whether you would like to continue. If you say yes, you pay €29 per month (instead of €49) for as long as you stay.
  • If you say no, or don’t answer, your website goes offline 14 days after the trial ends.

4. Prices and payment

Outside early access, the price is €199 once for the setup and €49 per month for hosting and support.

As a small business under § 19 of the German VAT Act (UStG), we charge no VAT; all prices are final prices.

We invoice monthly in advance by email. Invoices are payable by bank transfer within 14 days.

5. Contract term and cancellation

If you continue after the trial, the contract runs month by month, with no minimum term.

You can cancel at any time by email to hello@cyzex.com, effective at the end of the month. We can cancel with one month’s notice, effective at the end of a month.

6. Your content

You provide the texts, logo and photos for your website and confirm that you have the rights to use them and the consent of the people shown in them. Your texts and photos stay yours.

You are responsible for the content you provide and for the details in your website’s legal notice and privacy policy. We set up these pages from your details, but we don’t give legal advice.

When the contract ends, we send you your texts and photos on request.

7. Availability and liability

We aim to keep your website available at all times, but we can’t guarantee uninterrupted availability. Where possible, we announce planned maintenance in advance.

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence, we are liable only for breaches of essential contractual obligations – obligations that make the proper performance of the contract possible in the first place and on which you may regularly rely – and only for the typical, foreseeable damage.

8. Data protection

How we handle personal data is described in our privacy policy. Where your website processes personal data, for example through a contact form or bookings, we conclude a data processing agreement with you (Art. 28 GDPR).

9. Final provisions

German law applies. As far as legally permitted, the place of jurisdiction is Berlin.

If a provision of these terms is invalid, the remaining provisions stay valid.
